ALGEMEEN

  1. Wij zijn Hot Yoga The Hague (HYTH), gevestigd aan Amare, Turfhaven 3, Den Haag en ingeschreven in het handelsregister onder de naam Hot Yoga The Hague B.V. met KVK-nummer 93248083.
  2. Deze algemene voorwaarden zijn van toepassing op alle activiteiten georganiseerd door Hot Yoga The Hague zoals lessen, workshops, trainingen, yogaretraites, online lessen, community-evenementen etc.
  3. Door deel te nemen aan activiteiten georganiseerd door Hot Yoga The Hague, gaat de deelnemer akkoord met de toepasselijkheid van deze algemene voorwaarden.
  4. Hot Yoga The Hague kan deze algemene voorwaarden wijzigen. De toepasselijke versie is de meest recente versie die beschikbaar is op de website.

DEELNAME

  1. Deelnemer is een persoon die deelneemt aan activiteiten georganiseerd door Hot Yoga The Hague zoals lessen, workshops, trainingen, community-evenementen, yogaretraites, in studio of online etc.
  2. Om deel te kunnen nemen, moet de persoon zich eerst registreren bij Hot Yoga The Hague. Een volledige betaling voor een les moet vóór de les worden gedaan, tenzij anders overeengekomen of vermeld.
  3. Om je plek in een les te garanderen, raden we je aan om je les te reserveren op de website voordat je naar de studio komt. Er zijn geen kosten verbonden aan het maken van een reservering. Het principe ‘wie het eerst komt, wie het eerst komt, wie het eerst komt’ is altijd van toepassing.
  4. De studio is 30 minuten voor aanvang van de les open voor de door jou gekozen les. Kom uiterlijk 5 minuten voor aanvang van de les. We beginnen de les op tijd en de deur is gesloten.
  5. Deelname aan activiteiten die door HYTH worden georganiseerd, is op eigen kosten en risico. Meld eventuele verwondingen en/of fysieke beperkingen, zwangerschap, hoge bloeddruk vóór aanvang van de les.
  6. Alle overeenkomsten of contracten moeten schriftelijk worden vastgelegd. Mondelinge overeenkomsten worden niet geaccepteerd.
  7. Het management en personeel van HYTH behouden zich het recht voor om deelname te weigeren aan een persoon die zich, naar de mening van HYTH, respectloos gedraagt of een bedreiging vormt voor iemand in de studio.
  8. Betalingsverplichtingen van de deelnemer aan wie deelname is geweigerd, blijven ongewijzigd.
    Voor jouw eigen veiligheid en die van iedereen anders, zijn er twee camera’s geïnstalleerd in de receptie/lounge.

ROOSTER

  1. Het schema is beschikbaar op de website. Controleer het rooster voordat u een les volgt.
  2. Hot Yoga The Hague behoudt zich het recht voor om op elk moment een les te wijzigen of te annuleren of de docenten te wijzigen. Wijzigingen worden zo snel/ver mogelijk gecommuniceerd via Mindbody, de website of via de nieuwsbrief. Mocht de annulering het gevolg zijn van overmacht, dan kunnen abonnementen of leskaarten dienovereenkomstig worden verlengd.
  3. In principe worden de lessen het hele jaar door gegeven, met uitzondering van officiële feestdagen. Het rooster wordt indien nodig aangepast tijdens de zomer-/schoolvakanties.

ANNULERINGEN

  1. U kunt uw inschrijving tot 2 uur voor aanvang van de les annuleren via Mindbody.
  2. Bij late annuleringen en no-shows wordt de les zonder voorafgaande kennisgeving van de leskaarten afgetrokken. Voor abonnees kunnen frequente late annuleringen resulteren in het verlies van het recht om de les online te reserveren.
  3. Als de les vol is, kunnen deelnemers zich inschrijven op de wachtlijst voor die les. In het geval van een annulering ontvangt iedereen op de wachtlijst een pushmelding met de informatie over de beschikbare plek. Inschrijving vindt plaats op basis van wie het eerst komt, het eerst maalt.

AANKOPEN EN TERUGBETALING

  1. Alle transacties met Hot Yoga The Hague zijn definitief en kunnen niet worden terugbetaald of overgedragen.
  2. De prijzen voor diensten en producten zijn te vinden op onze website en in de studio. Hot Yoga The Hague behoudt zich het recht voor om de prijzen van lessen, workshops en alle geleverde producten of diensten te wijzigen.  Eventuele wijzigingen worden zo snel mogelijk gecommuniceerd via onze website, nieuwsbrief of sociale media.
  3. De introductieaanbieding van 2 weken is geldig voor iedereen die deze nog nooit eerder bij Hot Yoga The Hague heeft gekocht.
    Voltijdstudenten met een geldig identiteitsbewijs en jonger dan 35 jaar krijgen 15% korting op de yogaleskaart en het lidmaatschap.

ALGEMENE VOORWAARDEN: INTRODUCTIEAANBIEDING, LESKAARTEN & LOSSE LESSEN

2 weken Introductieaanbieding (“Intro”) – €27

  1. De geldigheidsduur van 2 weken gaat in op de dag van de eerste les.
  2. Je kunt gedurende deze 2 weken deelnemen aan alle lessen op het rooster, inclusief online lessen.
  3. Voor workshops, houdingsclinics of speciale lessen kan een afwijkend tarief gelden.
  4. Niet overdraagbaar en niet restitueerbaar.

Leskaarten

  1. Kaart voor 5 lessen: 6 maanden geldig.
  2. Kaarten voor 10 & 20 lessen: 12 maanden geldig.
  3. Verlenging van een verlopen leskaart met 3 maanden: €25.
  4. Je kunt het tegoed gebruiken voor elke gewenste les op het rooster, inclusief online lessen.
  5. Voor workshops, houdingsclinics of speciale lessen kan een afwijkend tarief gelden.

Losse les (studio) – €24

  1. Eén les in de studio.

Losse online les – €12

  1. Eén online les.

LIDMAATSCHAPPEN: MAAND- EN JAARKAARTEN EN ABONNEMENTEN

Onbeperkt (1 maand) – €130

  1. De geldigheidsduur van 1 maand gaat in op de dag van aankoop.
  2. Je kunt gedurende deze maand deelnemen aan alle lessen op het rooster, inclusief online lessen.
  3. Voor workshops, houdingsclinics of speciale lessen kan een afwijkend tarief gelden.
  4. Het abonnement voor 1 maand onbeperkt kan niet worden gepauzeerd.

Onbeperkt (3 maanden) – €350

  1. De geldigheidsduur van 3 maanden gaat in op de dag van aankoop.
  2. Je kunt gedurende deze 3 maanden deelnemen aan alle lessen op het rooster, inclusief online lessen.
  3. Voor workshops, houdingsclinics of speciale lessen kan een afwijkend tarief gelden.
  4. Het abonnement voor 3 maanden onbeperkt kan niet worden gepauzeerd.

Jaarlidmaatschap onbeperkt – €1150

  1. De jaarkaart wordt vooraf en in één keer betaald.
  2. De jaarkaart is geldig vanaf de dag van aankoop en verloopt na 1 jaar.
  3. Je kunt deelnemen aan alle lessen op het rooster, inclusief online lessen.
    Voor workshops, houdingsclinics of speciale lessen kan een afwijkend tarief gelden.
  4. De jaarkaart kan niet worden gepauzeerd.

Doorlopend onbeperkt maandabonnement (automatische incasso) €105 (of, indien afgesloten na het Introductieaanbod, €90 voor de eerste 12 maanden)

  1. De geldigheidsduur gaat in op de dag dat het abonnement wordt afgesloten.
  2. Onbeperkt aantal lessen.
  3. Voor workshops, houdingsclinics of speciale lessen kan een afwijkend tarief gelden.
  4. Voor dit abonnement geldt een minimale looptijd van drie maanden.
  5. Dit abonnement kan één keer per jaar voor de duur van één maand worden gepauzeerd; dit dient uiterlijk twee weken voor de beoogde datum per e-mail te worden bevestigd via info@hotyogathegue.com.
  6. De abonnementskosten worden voldaan via automatische incasso (SEPA). Hiervoor ontvangt de abonnee een incasso-overeenkomst (doorlopende SEPA-machtiging) van Hot Yoga The Hague.
  7. Deelnemers kunnen geen lessen meer reserveren indien de verschuldigde termijnbetaling niet kan worden afgeschreven. Dit kan bijvoorbeeld gebeuren door onvoldoende saldo op de opgegeven bankrekening op het moment van afschrijving, onjuiste betaalgegevens, of indien een deelnemer de betaling voor een periode (onterecht) storneert.
  8. Hot Yoga The Hague behoudt zich het recht voor om bij een onterechte stornering de storneringskosten aan de abonnee in rekening te brengen.
    Om dit abonnement op te zeggen, dient u uw opzeggingsverzoek ten minste twee weken voor de gewenste einddatum in te dienen en dit per e-mail te bevestigen aan info@hotyogathehague.com.
  9. De deelnemer blijft aansprakelijk voor alle termijnbetalingen totdat het abonnement is beëindigd conform de voorwaarden onder punt 9.

Doorlopend onbeperkt maandabonnement uitsluitend voor online lessen (automatische incasso) €50

  1. Het abonnement voor online lessen is uitsluitend geldig voor online lessen die in het lesrooster staan vermeld.
  2. Er geldt een afwijkend tarief indien u een les in de studio volgt.
  3. De geldigheidsduur gaat in op de dag dat het abonnement wordt afgesloten.
    Onbeperkt aantal lessen.
  4. Voor workshops, houdingsclinics of speciale lessen kan een afwijkend tarief gelden.
  5. Voor dit abonnement geldt een minimale looptijd van drie maanden.
    Dit abonnement kan één keer per jaar voor de duur van één maand worden gepauzeerd; dit dient uiterlijk twee weken voor de beoogde datum per e-mail te worden bevestigd via info@hotyogathegue.com.

  8. Hot Yoga The Hague behoudt zich het recht voor om de storneringskosten bij de abonnementhouder in rekening te brengen in geval van een onterechte stornering.
  9. Om dit abonnement op te zeggen, dient u uw opzeggingsverzoek ten minste twee weken voor de gewenste einddatum in te dienen en dit per e-mail te bevestigen aan info@hotyogathehague.com.
  10. De deelnemer blijft aansprakelijk voor alle termijnbetalingen totdat het abonnement is beëindigd conform de voorwaarden onder punt 11.

AANSPRAKELIJKHEID

Deelname aan activiteiten die worden georganiseerd door Hot Yoga The Hague en/of het gebruik van de faciliteiten van Hot Yoga The Hague is op eigen kosten en risico. Hot Yoga The Hague, inclusief management, personeel en docenten, aanvaardt GEEN aansprakelijkheid voor enige fysieke en/of mentale schade of letsel, verlies of schade, gerelateerd aan het volgen van lessen, workshops, trainingen en/of het gebruik van de faciliteiten van Hot Yoga The Hague. Bij twijfel over uw gezondheid, raadpleeg dan eerst een arts of medisch professional voordat u deelneemt. Door deel te nemen aan een les, accepteert u de Algemene Voorwaarden van Hot Yoga Den Haag. Alle overeenkomsten worden beheerst door het Nederlands recht en eventuele geschillen dienen uitsluitend te worden beslecht door de bevoegde rechtbank in Den Haag.

GENERAL

  1. We are Hot Yoga The Hague (HYTH), located at Amare, Turfhaven 3, Den Haag and Registered in trade register under the name Hot Yoga The Hague B.V. with KVK number 93248083.
  2. This General Terms and Conditions applies to all activities organized by Hot Yoga The Hague such as lessons, workshops, training courses, yoga retreats, online classes, community events etc.
  3. By participating in any activities organized by Hot Yoga The Hague, the participant agrees to the applicability of these General Terms and Conditions.
  4. Hot Yoga The Hague may change these General Terms and Conditions. The applicable version is the recent version available on the website.

PARTICIPATION

  1. Participant is a person who participate in any activities organized by Hot Yoga The Hague such as classes, workshops, training, community events, yoga retreats, in studio or online etc.
  2. To be able to participate the person has to be registered first at Hot Yoga The Hague. A full payment for a class has to be made before class unless otherwise agreed or stated. 
  3. To guarantee your spot in a class, we recommend you to reserve your class on the website before you come to the studio. There are no costs associated with making a reservation. First Come First Basis always applies.
  4. The studio will be open to your chosen class 25 minutes before the class start. Please arrive no later than 5 minutes before class. We start the class on time and the door will be closed.
  5. Participation in any activities organised by HYTH is at your own expense and risk. Please report any injuries and/or physical limitations, pregnancy, high blood pressure before the start of the class.
  6. All agreement or contract must be documented in writing. Verbal agreement will not be accepted.
  7. The management and staff of HYTH reserves the right to deny participation to any individual who, in HYTH’s opinion, behaves disrespectfully or poses a threat to anyone in the studio. Payment obligations of the participant who has been denied participation, remain unchanged.
  8. For your own safety and everybody else, two cameras are installed in the reception/lounge area.

SCHEDULE

  1. The schedule is available on the website. Please check the schedule before taking a class.
  2. Hot Yoga The Hague reserves the right to change or cancel class or change teaching staff at any time. Any changes will be communicated, as soon/far as possible either through Mindbody, website or by Newsletter. Should the cancellation happens as a result of force majeure, any subscriptions or class card can be extended accordingly.
  3. In Principle, classes are given all year round, with the exception of official holidays. The schedule will be adjusted as needed during summer/school holidays.

CANCELLATIONS

  1. You can cancel your registration through Mindbody up to 2 hours before the class begins.
  2. In the case of late cancellations and no shows, the class will be deducted from the class cards without prior notice. For subscribers, frequent late cancellations may result in the loss of privilege to reserve the class online.
  3. If the class reaches full capacity, participants can enroll on the waiting list for that class. In the even of a cancellation, everyone on the waiting list will be sent a push notification informing them of the available spot. Enrollment will be on a first-come, first-served basis.

PURCHASES AND REFUND

  1. All transaction made with Hot yoga The Hague are final and cannot be refunded or transferred.
  2. The prices for services and products can be found on our website and in the studio. Hot Yoga The Hague retains the right to modify the prices of classes, workshops, and any products or services provided. Any changes will be communicated as soon as possible through our website, newsletter, or social media.
  3. The 2-week introductory offer is valid for anyone who has never purchased it before from Hot Yoga The Hague.
  4. Full time student with a valid ID and under 35 years old receives 15% discount on yoga class card and membership.

INTRO OFFER, CLASS CARDS & DROP-INS TERMS AND CONDITIONS

2 weeks’ Introduction Offer (“Intro”) €27

  1. Validity starts from date if first class attendance and valid for 2 weeks.
  2. You can join any classes you desired available on the schedule, including online classes, for 2 weeks.
  3. A different rate may apply for workshops/posture clinic or special classes.
  4. Non transferable and nonrefundable.

Class Cards

  1. 5 Class Card valid for 6 months.
  2. 10 & 20 Class Card valid for 12 months.
  3. €25 to extend any expired class card by 3 months.
  4. You can use the credit to join any class you desire available on the schedule, including online classes.
  5. A different rate may apply for workshop/posture clinic or special class.

Drop In €24

  1. Single studio class.

Online Drop In €12

  1. Single on-line class.

MEMBERSHIPS: MONTHLY & ANNUAL CARDS and SUBSCRIPTIONS

1-Month Unlimited €130

  1. Validity starts from when the card is purchase and valid for 1 month.
  2. You can join any classes you desired available on the schedule, including online class, for 1 month.
  3. A different rate may apply for workshops/posture clinic or special class.
  4. No pause for 1-Month Unlimited.

3-Month Unlimited €350

  1. Validity starts from when the card is purchase and valid for 3 months.
  2. You can join any classes you desired available on the schedule, including online class, for 3 month.
  3. A different rate may apply for workshop/posture clinic or special class.
  4. No pause for 3-Month Unlimited.

Annual Member Unlimited €1150

  1. Annual Card is paid in advance and in one go.
  2. An Annual Card is valid from the day of the card purchased and expired after 1 year.
  3. You can join any classes you desired available on the schedule including online class.
  4. A different rate may apply for workshop/posture clinic or special class.
  5. No pause for Annual card.

Continuous Unlimited Monthly Subscription (direct debit/autopay subscription) €105 (or if purchased after Intro offer, for first 12 Months only: €90)

  1. Validity starts from the day the subscription is entered.
  2. Unlimited classes.
  3. A different rate may apply for workshop/posture clinic or special class.
  4. A minimum term of three months is required for this subscription.
  5. This subscription can be pause for one month annually, confirmed by email via info@hotyogathegue.com, no later than two weeks before the intended date.
  6. The subscription fees are paid by direct debit (SEPA). For this purpose, the subscriber will receive a direct debit agreement (continuous authorisation SEPA) from Hot Yoga The Hague.
  7. The participants can no longer reserve a class should the due instalment payment cannot be debited. This could happen for example because of insufficient balance on the specified bank account at the time of debit, incorrect payment information, also in the event that a participant (unjustifiably) reverses the payment for a period.
  8. Hot Yoga The Hague reserves the right to charge the reversal costs to the subscriber In the event of unjustified reversal.
  9. To terminate this subscription, you must submit your cancellation request at least two weeks in advance of your desired end date, and confirm via email to info@hotyogathehague.com
  10. The participant remains liable for all instalment payments until the subscription has ended in accordance with the conditions under point number 9.

Online Classes Only Continuous Unlimited Monthly Subscription (direct debit/autopay subscription)  €50

  1. Subscription for online class is valid only for online classes only that are available on the schedule.
  2. A different rate applies if you attend a class in studio.
  3. Validity starts from the day the subscription is entered.
  4. Unlimited classes.
  5. A different rate may apply for workshop/posture clinic or special class.

LIABILITY

Participating in any activities organising by Hot Yoga The Hague and/or by using the facilities at Hot Yoga The Hague is at your own expense and risk. Hot Yoga The Hague, including managements, staff and teachers accepts NO liability for any physical and/or mental harm or injuries, loss or damage, related to attending classes, workshops, training and/or by using the facilities of Hot Yoga The Hague. When in doubt about your health, consult a doctor or medical professional first before participating. By participating in a class means you accept the General Terms and Conditions of Hot Yoga The Hague. All agreements are governed by Dutch Law and any dispute arises must be resolved exclusively in the appropriate court located in The Hague.

PRIVACYBELEID

Hot Yoga The Hague respecteert en waardeert de privacy van haar deelnemers. Wij gaan zorgvuldig om met uw persoonsgegevens en houden ons aan de bepalingen van de Wet bescherming persoonsgegevens.

Zo gaan wij om met uw persoonsgegevens:

  1. Al onze medewerkers zijn verplicht om vertrouwelijk om te gaan met uw persoonsgegevens.
  2. Uw persoonsgegevens worden beschermd tegen ongeautoriseerde toegang.
  3. Wij verzamelen uw persoonsgegevens alleen voor een specifiek doel:
    1. om uw lidmaatschap te registreren voor een abonnement of leskaart.
    2. om uw lidmaatschap te onderhouden.
    3. om betalingsopdrachten uit te voeren, zoals automatische incasso of creditcardbetaling via Mindbody-boekingssoftware.
    4. voor administratieve en verantwoordingsplicht aan de Belastingdienst.
    5. In principe vinden er geen verwerkingen van gegevens plaats voor andere doeleinden.
  4. Een deel van de gegevens wordt buiten de EU verwerkt, onder meer via Mindbody voor het boekingssysteem en Mailchimp voor nieuwsbrieven. Uw persoonsgegevens worden alleen bewaard zolang dat nodig is, doorgaans gedurende een periode van 7 jaar na uw laatste activiteit, tenzij een langere bewaartermijn wettelijk verplicht is.
  5. Als u uw rechten onder de AVG wilt uitoefenen, neem dan contact met ons op via info@hotyogathegue.com. We zullen uw verzoek beoordelen en samenwerken om de beste oplossing te vinden.
  6. Onze website monitort algemene bezoekersgegevens anoniem met behulp van Google Analytics. Deze informatie is bedoeld om het ontwerp van de website te verbeteren. Daarnaast kan het worden gebruikt om meer op maat gemaakte inhoud aan bezoekers te presenteren.

 

PRIVACY POLICY

Hot Yoga The Hague respect and value the privacy of its participants. We handles your personal data with care and observes the provisions of the Personal Data Protection Act.

Here is how we handle your personal data:

  1. All our employees are obliged to treat your personal data confidentially.
  2. Your personal data is protected against unauthorized access.
  3. We only collects your personal data for a specific purpose:
    1. to register your membership for either subscription or class card.
    2. to maintain your membership.
    3. to execute payment orders such direct debit or credit card payment via Mindbody booking software.
    4. for administrative and accountability to the Tax and Customs Administration.
    5. In principles, no processing data take place for other purposes.
  4. Some of the data is process outside of the EU including via Mindbody for booking system and Mailchimp for newsletters.Your personal data will be retain only for as long as necessary, typically for a period of 7 years following your last activity, unless a longer retention period is mandate by legal requirements.
  5. If you wish to exercise your rights under GDPR, please reach out to us at info@hotyogathegue.com. We will review your request and work together in finding a best solution.
  6. Our website monitors general visitor data anonymously using Google Analytics. This information is intended to improve the website’s design. Additionally, it can be used to present more tailored content to visitors.
